Terms of service

Plain-language policy. Last updated 21 September 2026. Operated by Bahamas Market LLC.

1. The agreement

These terms are a contract between you and Bahamas Market LLC ("we"), which operates BHS Market at bhsmarket.com, the site's Telegram bot and its emails (together, "the site"). By using the site you agree to these terms, the posting rules and the privacy policy. If you do not agree, do not use the site.

2. Who may use the site

• You must be at least 18 years old to create an account, post an ad, bid or send messages. Browsing is open to everyone.
• You must be able to enter into a binding contract, and you must not have been banned from the site before.
• Businesses (dealers, agents, brokers, shops) are welcome and must say so in their ads where the law requires it, and must follow Bahamian consumer protection rules.

3. Your account

• Give us a working email address, or use the site through Telegram. You are responsible for everything done from your account, so keep your sign-in link, password, passkey and Telegram account to yourself.
• One person, one account, unless we agree otherwise (for example a business account run by staff).
• Tell us straight away at [email protected] if you think someone else is using your account.

4. Ads and your responsibility

When you post an ad you promise that:

• you own the item or are allowed to sell or rent it;
• everything in the ad is accurate and not misleading: the description, price, condition, location, and the photos are of the actual item;
• the sale is legal in The Bahamas, including any licence, permit, title, duty or registration the item needs (vehicles, boats, firearms, property, animals);
• you will honour the price and terms you advertised, and tell buyers promptly if the item is no longer available (mark it sold or withdraw it).

You, the seller, are solely responsible for your ad and for the sale. We review ads before they go live and may edit categories or reject ads, but a review does not mean we have checked the item or vouch for it.

5. What you may not post

The full list is in the posting rules. In short, you may not post: illegal goods or services; firearms, ammunition and weapons; drugs and drug paraphernalia; stolen goods; counterfeit or pirated goods; recalled or unsafe products; protected wildlife and products made from it; adult services or sexual content; anything that promotes hate or violence; get-rich-quick, pyramid or multi-level marketing schemes; job ads that ask for payment; or an ad for something you do not actually have. We may remove any ad that breaks the rules or that we consider harmful, without notice.

6. Acceptable use

Do not:

• scam, defraud or deceive anyone, or ask for deposits or payments for items you do not have;
• harass, threaten or abuse other users, or send them spam or unsolicited offers;
• post the same item more than once, or repost to jump the queue (use the paid bump instead);
• put phone numbers, links or contact details in places meant to keep you safe, such as the description, when the site gives you a proper place for them;
• scrape, crawl or copy the site in bulk, or use bots to post, bid or message;
• try to get around moderation, bans, rate limits or security measures, or interfere with the site's operation;
• impersonate anyone, or use another person's photos or details without permission.

7. Auctions and bidding

• A bid is a binding offer to buy at that price. Do not bid unless you intend to pay and collect.
• An auction ends at the stated time. A bid placed in the last 5 minutes extends the auction by the same amount so others can respond.
• When the auction ends, the highest bidder wins, unless the seller set a reserve price and the highest bid is below it. In that case there is no sale.
• The sale itself is between the winner and the seller: they agree how and where to pay and hand over the item. We do not hold money, ship items or guarantee that either side performs.
• Bidders who do not pay, and sellers who do not deliver to the winner, may be banned.

8. Credits, promoted ads and fees

• Posting a normal ad is free.
• Optional extras are paid with credits: bumping an ad, featuring it for 7 or 30 days, an urgent tag, an island spotlight, more photos on an ad, and listing an auction with a reserve price. The price of each extra, in credits, is shown before you confirm it.
• Credits are valid for 3 years from the day they are added to your wallet, whether bought or given. We spend the credits that expire soonest first. Credits still unused when they expire are removed.
• Credits are not money. They cannot be withdrawn, transferred or refunded once spent, except where the law requires a refund or where we failed to provide what you paid for.
• If we remove an ad because it broke these terms, any credits spent on promoting it are forfeited.
• Prices are in Bahamian dollars (BSD), which is pegged 1:1 to the US dollar.

9. Our role: we are not a party to any sale

BHS Market is a venue where people advertise and find items. We are not the seller, buyer, agent, broker, auctioneer or escrow of anything advertised on the site. Every sale, rental or job is an arrangement directly between the users involved. We do not inspect items, verify ownership, guarantee titles, hold payments or deliver anything. Please read our safety tips: meet in a public place, inspect before you pay, and never send money for something you have not seen.

10. No warranty

The site is provided "as is" and "as available". We do not promise that it will be uninterrupted, error-free or secure, that ads are accurate, that sellers or buyers are who they say they are, or that any item is as described. Anything you rely on from an ad, you rely on at your own risk.

11. Limits on our liability

To the fullest extent the law allows, Bahamas Market LLC, its owners and staff are not liable for any loss or damage arising from a sale, purchase, rental, job or contact made through the site, from an item advertised on it, from content posted by users, or from the site being unavailable or changed. This includes loss of money, goods, profit or data, and indirect or consequential loss. Where liability cannot be excluded, our total liability to you for all claims is limited to the amount you paid us in credits in the 12 months before the claim, or 50 Bahamian dollars, whichever is higher. Nothing in these terms limits liability for fraud or for anything that cannot be limited by law.

12. Removal and termination

• We may remove or edit any ad, message or content, and suspend or close any account, at our discretion, with or without notice, if we believe these terms or the posting rules have been broken, if we receive a credible report or legal demand, or to protect users or the site.
• You can close your account at any time by emailing [email protected]. Bids you have won and sales you have agreed still stand.
• Sections 9 to 11, 13 and 14 continue to apply after your account is closed.

13. Your content and our content

• You keep ownership of the text and photos you post. You give us a worldwide, royalty-free licence to show, store, resize, index and share them for the purpose of running and promoting the site, including in search engines and on social media, for as long as the ad exists and for a reasonable time after for cached copies.
• You promise you have the right to post what you post, including any photos.
• The site's name, logo, design and code belong to Bahamas Market LLC. You may link to any page, but you may not copy the site or its listings in bulk.
• If you believe an ad infringes your rights, email [email protected] with the ad link and the basis of your claim.

14. Governing law

These terms are governed by the laws of the Commonwealth of The Bahamas. Any dispute about the site or these terms will be brought in the courts of The Bahamas, and you agree to their jurisdiction. If part of these terms is found invalid, the rest still applies.

15. Changes

We may update these terms. The date at the top shows the current version. If we make a significant change we will show a notice on the site. Continuing to use the site after a change means you accept the new terms.
